The Via Protections program includes three types of protections as well as legal assistance telephone services that are offered to purchasing and selling clients by participating Via Capitale brokers.
HOMEOWNER PROTECTION

You have accepted a promise to purchase on your property for $300,000. Following the death of the buyer, the buyer's estate is not interested in acquiring the property. You put the property back on the market and after multiple negotiations, the offer received is of $290,000. The difference in selling price of $10,000 and various costs incurred can be paid to you by Via Capitale.
What does Homeowner Protection consist of?
Homeowner Protection protects the seller who, after accepting a promise to purchase whose conditions have been fulfilled, and who has or will soon take possession of his new home, is faced with a situation where the buyer:
- Delays the signing of the deed of sale
- Withdraws from the promise to purchase
- Passes away accidentally
- Becomes unfit
Homeowner Protection provides reimbursement of several costs incurred on the property as well as compensation for the sale price differential.. Maximum compensation is $25 000 .
In addition, the seller does not need to pay a deductible: another market exclusive
Owner Protection takes effect on the 15th day after the date the deed of sale is signed and is offered for a maximum of 180 days or until the date of resale of the home, whichever occurs first.
What are the eligibility requirements? *
The owner-seller must be a natural person occupying the building or an estate or a curate and be under brokerage contract at all times for the sale of his home with a participating Via Capitale broker.
The building must consist of a maximum of 4 units, at least one of which is occupied by the owner, used strictly and entirely for residential purposes, inhabitable year-round and subject to a promise to purchase of over $75,000.
New buildings, buildings subject to a judicially controlled sale or mortgage repossessions, as well as buildings that have been vacant for over 90 days are excluded.

What does Mortgage Protection consist of?
Mortgage Protection is available free of charge to buyers who have:
- Purchased a property through a Via Capitale broker
- Contracted their mortgage for a fixed term with one of Via Capitale's partnering financial institutions.
Mortgage protection takes effect when the buyer:
- Becomes unexpectedly unemployed(position abolishment, business closure, wrongful dismissal)
- Passes away accidentally
Mortgage Protection refunds mortgage payments. In the case of a job loss, it also covers common condo fees. The maximum compensation is of $ 25 000 .
Mortgage Protection takes effect on the day the deed of sale is signed and is available for up to 12 months.
What are the eligibility requirements? *
In the case of a job loss, the owner must have been employed full-time (more than 30 hours per week) for the last 12 consecutive months.
The building must consist of a maximum of 4 units, at least one of which is occupied by the owner, used strictly and entirely for residential purposes and subject to a promise to purchase of over $75,000.

You will be relieved to be able to count on your Via Capitale Homeowner Protection to be referred to a qualified repairman who will fix this for you without delay.
What does Homebuyer protection consist of?
Homebuyer Protection is available to buyers who have purchased a property through a participating Via Capitale broker. It applies in the event of sudden breakage, breakdown or unexpected default that requires repair:
- Household appliances included in the sale (stove, range hood, dishwasher, etc.)
- Electrical, plumbing, heating, ventilation and air conditioning systems located inside the main residence, in the heated garage or as part of the heat pump. **
Note: Devices and systems and their equipment must be in good working condition on the date the deed of sale is signed.
Homebuyer Protection covers repair costs up to $1,000 per claim (taxes included) and a maximum of $10,000 per coverage period. A deductible of $100 per claim applies.

LEGAL ASSISTANCE: A USEFUL TOOL FOR THE BUYER AND THE SELLER
What does Legal Assistance consist of?
Legal Assistance is a free telephone service that offers legal information provided by a lawyer for all legal matters related to private life, such as: hidden defects, contracts, neighbourhood disturbances, housing, wills, taxes, family law, consumer law, and employment rights, and more*.
- Unlimited number of calls;
- No call time limit;
- Confidential and bilingual service;
- Callback from a lawyer with at least 5 years of experience within 48 hours.
The service is available from Monday to Friday between 9 a.m. and 6 p.m. by calling 1-877-491-2433.
For sellers, free legal assistance is available from the moment all the terms of the promise to purchase are fulfilled and for a period of 12 months following the signing of the deed of sale.
For buyers,, the free legal assistance service is available for a period of 12 months following the signing of the deed of sale.
What are the eligibility requirements? *
To be eligible for legal assistance, the seller must be eligible for Homeowner Protection and the buyer must be eligible for Homebuyer Protection.
